JAMMU, Jan 17: Chief patron of National Panthers Party Prof Bhim Singh has urged upon the President of India for his immediate intervention in J&K to save the State from further death and destruction.
In a press statement the NPP leader said that President is the only person in the Indian hierarchy who is competent under Article 370 read with Article 174 of the Constitution of India to dissolve the State Assembly to enable the electorates to elect fresh Assembly in the State to end the present political crisis which erupted due to demise of the Chief Minister, Mufti Mohd Sayeed.
Prof Singh urged the President that the political crisis in J&K cannot be resolved as long as present State Assembly is dissolved and fresh elections are held. He said that the artificial combination of PDP and BJP had sown poisonous seeds of conflict and distortion because of the combination of two parties having political agendas vertically opposed to each other. He said that National Conference leaders offered to join hands with BJP to form the Government is equally dangerous and cannot provide a governance at all.
NPP supremo urged the President to immediately amend provision in Article 370 (3) of Constitution of India which provides, “That the recommendation of the Constituent Assembly of the State referred to in clause (2) shall be necessary before the President issues such a notification.”
Prof Singh said that this provision was valid till August 20, 1952, the day when the Monarchy (rule of Maharaja Hari Singh) was abolished by the Constituent Assembly headed by Sheikh Mohd Abdullah. This provision has become infructuous and therefore, the President has absolute power to declare that Article 370 shall cease to be operated with an immediate effect.
The NPP leader made a strong appeal to all the Members of the Parliament as well as the political parties which stand by the concept of National Integration to urge the President of India to declare Article 370 as void so that the Parliament of India is declared competent to deal with the constitutional matters vis-à-vis Jammu and Kashmir. Prof Singh also urged President to direct the Prime Minister to hold a meeting of all the political parties including the recognized political parties of J&K to seek their opinion in this regard.
