Go ahead with floor test for LAHDC Kargil Chairman post: DB

JAMMU, Aug 24: Division Bench of State High Court comprising Chief Justice N Paul Vasanathakumar and Justice Dhiraj Singh Thakur today allowed the State to go ahead with the floor test for the post of Chairman of Ladakh Autonomous Hill Development Council (LAHDC), Kargil.
The direction was passed in a LPA seeking stay on floor test for the post of Chairman LAHDC Kargil.
After hearing Advocate Mohsin Qadri appearing for the appellant whereas Advocate General Jehangir Iqbal Ganai appearing for the State, the DB observed, “Advocate General has produced notification dated 12.08.2016 directing that for the words “each elected member” appearing in Clause (c) of Rule 94 A of the Ladakh Autonomous Hill Development Council (Election) Rules, 1995, the words “each member” shall be substituted and nominated members can vote”.
“The floor test, which is scheduled to be held on August 27, 2016 shall be conducted but the declaration of the result shall be subjected to result in the writ petition as well as the appeal”, the DB said.
