Go ahead with FAK inquiry: HC

SRINAGAR, Apr 22: Jammu and Kashmir High Court today directed the Government to go ahead with the inquiry initiated against Food Analyst Kashmir (FAK), who was found responsible in shielding M/s Khyber Agro Farms Pvt Ltd in manufacturing adulterated and substandard food items.
The Food Analyst Officer, Hamidullah Dar, had challenged the Government order wherein inquiry was ordered against him following his negligence in performing the duty in checking the menace of food adulteration and further he had been attached by the authorities.
Dar was seeking expunging the observations which have been passed against him by the trial court in the judgment wherein penalty of Rs 9 lakh and 6 months imprisonment was given to M/s Khyber Agro for processing adulterated and substandard food including milk.
Justice Ali Mohammad Magrey after hearing both the parties at length said the issue involved in the petition is directly connected with the subject matter of PIL wherein court has taken suo-moto cognizance of food adulteration menace in the State and directed the registry to list this (Dar’s) petition along with that PIL which is listed on April 25 by the orders of DB.
“Therefore in view of the same, Registry shall take steps for listing of the matter along with the PIL, after seeking orders from the Chief Justice,” court, adding with “till listing of the matter along with PIL, respondents are free to conduct inquiry  against the petitioner  already initiated, however the final orders shall not be passed”, Justice Magrey said.
