JAMMU, Nov 26: For the first time since its establishment in 1996, the Sessions Court Kargil today convicted an accused under Section 302 RPC and awarded him life imprisonment.
According to the facts of the case, the complainant, who hails from Nepal contracted second marriage with accused Bhagwat Das of Jharkhand. Both were working at Kargil in private sector.
The first husband of the complainant had died and out of the first marriage the complainant had two children. The accused with whom she contracted second marriage never accepted the step children and always rebuked them.
He always had a quarrel with the complainant on the basis of children who were three and eight years old. One night, he had a quarrel with the complainant, who got annoyed and left home. When she returned after sometime she found her three year old daughter missing.
Next morning she with the assistance of some locals found the dead body of her daughter near a septic tank. Her throat was strangulated and head was hammered with stone.
Accordingly, the accused was arrested and after completion of investigation challan was presented in the court of law.
After testing the entire incriminating evidence, Sessions Judge came to the conclusion that evidence on record was well-connected and qualified the test laid down in the judgement of Supreme Court titiled Sharad Birdhichand Sarda Versus State of Maharashtra for conviction based on circumstantial evidence.
After hearing the Public Prosecutor on quantum of punishment and counsel for the accused, the Court opined that the case doesn’t fall in the rarest of the rare category for awarding capital punishment.
Accordingly, the convict was awarded life imprisonment.
