Srinagar, Mar 13: High Court today directed the authorities not to withdraw the Government vehicle provided to the senior Congress member Muzaffar Parray till appropriate decision is taken.
Petitioner Parray claims that he is sitting Member of Legislative Council (MLC) and is yet to complete his term and projected in his petition that the Government vide its communication bearing No. Home /Acctts/58/20154/4877 dated 25.8.2015 has come up with a policy with regard to the retention/purchase of the vehicles allotted to MLAs/MLCs.
The communication envisages that MLAs/MLCs will continue to use vehicles allotted to them for entire duration of their tenure i.e. six years and after the tenure is completed, they would be at liberty to produce the vehicles as its depreciated value as determined by the State Motor Garages and approved by the competent authority regardless of the fact that whether they are re-elected or not.
Court has been informed that though the policy is in vogue since 25th August, 2015 but the same is not implemented by the respondents and the specific issue was raised in the Legislative Council by one Ghulam Nabi Monga, and in response thereof the then Minister for Parliamentary Affairs had stated that issue regarding the implementation of the policy would be taken up with the Director General of Police and the Home Department.
Justice Sanjeev Kumar directed the authorities to take an appropriate decision in the matter within a period of two weeks from today and in any case before the petitioner complete his tenure. “Till then the vehicle which is already at the disposal of the petitioner shall not be withdrawn”, court directed.
