DGP decision not to induct cop can’t be challenged: HC

Srinagar, May 15: High Court today said the decision of Director General of Police as to whether the petitioner is or not suitable for induction into force cannot be challenged before High Court.
Hearing a petition filed by one Imtiyaz Ahmad Malla seeking reinstatement in the force and quashing of order No. 2580 of 2017 dated 31-07-2017, by virtue of which the respondents have rejected his claim for appointment as Constable in J&K Police. Justice M K Hanura while dismissing the claim of petitioner said the importance of the integrity and high standard of conduct in police force has to be taken  into consideration in the matter of forming an opinion whether his retention in the police force is or is not justifiable.
Court said, the Director General of Police, after looking into the pros and cons of the case took a decision that the petitioner is not a suitable person to man the post in view of his criminal background.
Referring the law as laid down, Court said, it  provides that the persons with impeccable character only can be allowed to make entry into the police force which is a disciplined one.
“The decision of the Director General of Police, that the petitioner is not suitable for his induction into the police force cannot be called in question before this court”, Justice Hanjura recorded in the judgment with the saying that  the Director General of Police, being the highest functionary in the police hierarchy is the best judge to consider this facet of the case.
