JAMMU, Aug 5: Division Bench of High Court comprising Justice Rajnesh Oswal and Justice Mohan Lal has upheld the detention under PSA of Gaggu Din, alias Gaggu, a hard core criminal.
While dismissing the LPA filed by appellant challenging the order of detention No. PSA/08 dated 10.08.2021 passed under the provisions of Section 8(1) (a) of the Jammu and Kashmir Public Safety Act, 1978 and the Single Judge vide judgment dated 17.12.2021, the DB observed, “the order of detention is a precautionary measure. It is based on a reasonable prognosis of the future behaviour of a person based on his past conduct in the light of the surrounding circumstances”.
With these observations, Division Bench upheld the judgment of writ court and dismissed the LPA.
