DB grants interim bail to ex-SP Operation, his PSO

JAMMU, May 15: In the much publicized killing of PSI Ajay Gupta in which Trial Court has awarded life-imprisonment to Sewak Singhm the then SP (Operations) and his PSO Satpal Singh, Division Bench of State High Court comprising Justice Mohd Yaqoob Mir and Justice D S Thakur today granted interim bail to both of them subject to furnishing of surety bonds to the tune of Rs 1 lakh each to the satisfaction of Registrar Judicial Jammu and personal bond of the like amount each to the satisfaction of the Superintendent, Central Jail Kot Bhalwal.
After hearing Senior Advocate Sunil Sethi with Advocate Ravi Abrol for the petitioners whereas Senior AAG Gagan Basotra for the State, DB observed, “trial against the accused commenced with the framing of charge on February  3, 2000 and the same terminated in conviction recorded vide judgment dated February 2, 2012. It took 12 years for conclusion of the trial”.
“Now the appeals are also pending   for more than one year. On perusal of the interim orders recorded by the Trial Court from time to time  what would surface is that delay in trial is not exclusively attributable to the accused  who all along have remained in the custody”, the DB said while allowing the applications and granting interim bail to the then SP Operations and his PSO.
