JAMMU, June 3: In a Public Interest Litigation (PIL) filed by Ashiq Hussain and others regarding issuance of job cards to Government employees, students that too minor and dead persons under MNREGA scheme in connivance with revenue officials, Division Bench of High Court comprising Justice Ali Mohammad Magrey and Justice B S Walia today directed the State to expedite the grant of sanction for prosecution of the accused public servants.
“The respondents have already investigated the matter and taken the case to final conclusion, therefore, the instant Public Interest Litigation shall stand settled”, the DB said and directed the State to expedite the grant of sanction for prosecution of the accused public servants, so as to enable the Vigilance Organization to file a final report/ challan before the competent court of law against the accused persons.
“The respondents shall also ensure the departmental proceedings against the delinquent officials involved in committing such irregularities under MGNREGA scheme”, the DB further directed, adding “the Commissioner Secretary to Government, Rural Development Department in his response has admitted that some irregularities have been committed by some officers/officials while engaging persons under MGNREGA Scheme and that he has also referred the matter to Vigilance Organization for conducting investigation”.
“The status report filed by the Superintendent of Police, Vigilance Organization reveals that there are number of persons engaged, who are not eligible to obtain benefit under MGNREGA Scheme, still their job cards have been prepared to withdraw the amount”, the DB said.
