Srinagar, Nov 27: In order to save the agriculture and State land in Valley from encroachments, High Court today directed the Government to ensure implementation of Agrarian Laws, Statutory Provision and court orders passed from time to time as well directions passed by Supreme Court in this connection.
The Division Bench of High Court comprising Justice MH Attar and Justice Ali Mohammad Magrey, in a Public Interest Litigation on conversion of Agriculture land, directed Divisional Commissioner Kashmir and all Deputy Commissioners of Kashmir to ensure implementation of statutory provisions regarding encroachments on State land.
“Divisional Commissioner Kashmir is directed to ensure implementation of statutory provisions regarding removal of encroachments from Khacharie land and ensure that directions of the Supreme court and this court are implemented”, said the bench.
“The Divisional Commissioner shall be personally responsible to seek implementation of the provisions of the statute and court directions”‘, DB directed and sought compliance report from Divisional Commissioner about these directions by next date of hearing.
The direction to Divisional Commissioner was passed after the amicus curie to the PIL, advocate Jehangir Ganaie, brought to the notice of the court that despite directions issued from the court, requiring the concerned authorities to protect khacharie land and remove encroachments from the said land, no steps have been taken till date.
Court also directed all Deputy Commissioners of the State to comply faithfully with the statutory provisions and directions of the court issued from time to time and file fresh status report in this regard.
“Ensure that no violation of the court order is committed by any person. Any violation, if reported, to the court hereafter, will have serious repercussion on the conduct of the said authority”, DB directed DC Budgam.
Court further sought compliance report from the Commissioner Secretary Housing and Urban Development Department in terms of previous direction and in default he was directed to be present in person on next date of hearing.
