DB directs contemnors to file affidavit

JAMMU, Dec 30: In a contempt petition filed by AV Gupta in public interest litigation regarding direction to the State to provide basic health facilities for treatment of cancer in the State of Jammu and Kashmir, the Division Bench today directed the contemnors to file affidavit.
In the PIL, A V Gupta has sought direction to the State to provide adequate number of Oncologists, Oncosurgeons, PET scan machines and all other experts in the relevant field for the treatment of various types of cancer in all the regions of the Jammu & Kashmir.
The Division Bench, comprising Chief Justice Pankaj Mithal and Justice Javed Iqbal Wani, after hearing Adv Ajay Sharma- appearing for the petitioner, observed that Amit Gupta, Additional Advocate General appearing for Commissioner/Secretary Health & Medical Education, has submitted that very shortly by the mid of 2022 in the Super Specialty Hospital, Jammu a PET Scan Machine would be installed after necessary infrastructure for the purposes is in place.
Additional Advocate General, appearing for PSC, submitted that selection on one post of Oncologist has already been made but on the remaining two, the process has to be restarted as no candidate from the reserved category was eligible. He further submits that a fresh advertisement has been issued on 27th December 2021 and the process of selection would be completed very short.
Upon this, DB directed that an affidavit to this effect may be filed by both the contemnors within a period of one month.
