DB directives in PIL on Judicial Officers’ security, logos for vehicles

JAMMU, Mar 14: In a Public Interest Litigation filed by two practicing advocates namely Prem Sadhotra and Rajneesh Raina challenging the order whereby personal security cover of Judicial Officers was withdrawn in Jammu, Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today issued certain directions to the State Government.
After hearing Advocate Rohit Kapoor for the PIL whereas Advocate General DC Raina assisted by AAG WS Nargal appearing for the State, DB observed, “in the status report it has been mentioned that security personals provided to the uncategorized persons in District Jammu had already been withdrawn by order dated 01.12.2014. However, in compliance to the order of this court, security personnel to the retired Judicial Officers have been re-deployed by the District Police Jammu”.
During the course of arguments, Advocate General DC Raina produced latest communication received from ADGP of J&K Police which states that all the Judicial Officers in the province of Jammu as well as Kashmir have been provided with the Personal Security Officers. Upon this, Division Bench observed that the first part of prayer for providing security to the Judicial Officers stands complied with.
The second part of the prayer was with regard to implementation of Full Court Resolution dated 29.9.2008 whereby it was recommended that the Judicial Officers be permitted to display the logo on their private vehicles to avoid inconvenience during security checks and otherwise.
It was recommended by the Full Court that there shall be three types of logos. One carrying the description Chief Judicial Magistrate, second Judicial Magistrate and third Judge. The Logo will have the provision for Car Number being given. Registry shall issue Logos to the officers after ascertaining their car numbers.
On this prayer, Advocate Rohit Kapoor appearing for the petitioner submitted that as on today the resolution has not been implemented. Accordingly, the DB directed the concerned respondents including Commissioner/ Secretary Home Department to implement the resolution of the Full Court dated 25.09.2008 with regard to logos within a period of eight weeks from the date of receipt of copy of this order and immediately thereafter, the High Court Registry shall issue logos to the officers after ascertaining their car numbers.
