JAMMU, Feb 9: In a Public Interest Litigation (PIL) highlighting illegal encroachments by the shopkeepers and other unknown persons in the JDA Shopping Complex near City Chowk, Jammu and also in the adjoining areas, a Division Bench of High Court comprising Acting Chief Justice Tashi Rabstan and Justice Moksha Khajuria Kazmi has granted four weeks time to Advocate General for filing compliance of the orders dated 26.07.2019, 15.12.2021 and 09.03.2022.
Moreover, in the light of the fact that many departments are respondents in the PIL, the DB has directed that Divisional Commissioner Jammu shall act as Nodal Officer, who shall file composite compliance to all the directions passed by this court from time to time by or before the next date of hearing.
On July 26, 2019, DB had directed Commissioner, Jammu Municipal Corporation to furnish the information vis-à-vis whether the Municipal Corporation or the authority under the Food Safety and Standards Authority of India (FSSAI) has permitted the food-joints to run their establishments from the foot-path in question, whether the requisite licenses and permissions have been granted in favour of the Dhabas and shops near Jambulochan Complex and at Amphalla etc
On March 9, 2022, Division Bench had directed JDA to apprise the court about final outcome of 38 notices issued to the shopkeepers having shops in JDA Shopping Complex City Chowk, Jammu who have encroached the corridors.
Today DB said, “it is necessary to array Commissioner, Food Safety, Jammu as a party respondent”. Senior AAG Monika Kohli accepted notice on behalf of Commissioner, Food Safety, Jammu. DB further directed the Divisional Commissioner, Jammu/Nodal Officer to file response on behalf of the Commissioner, Food Safety, Jammu as well, by or before the next date of hearing.
