JAMMU, Mar 21: In a Public Interest Litigation (PIL) filed by one Kirpal Singh seeking implementation of Jan Aushadhi Scheme, Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan has issued some directions.
After hearing Advocate Munish Sharma appearing for the PIL whereas ASGI Sindhu Sharma appearing for the Union of India and Advocate Vikram Sharma appearing for the State, DB observed, “it has been submitted that the poor sections of the society suffer due to the higher cost of medicines available in the market or overcharging by private chemists during emergency and odd hours”.
“The Union of India in the year 2008 launched Jan Aushadhi Scheme, a poor friendly scheme which includes opening of Jan Aushadhi stores in every Government hospital throughout the country for which the Governments have to provide rent free accommodations in the Government hospitals. The main objective of the Jan Aushadhi Scheme is to provide high quality generic medicines to be sold at lower prices”, the DB said.
“The petitioner is seeking implementation of the scheme and quashing of the notification inviting tender dated November 27, 2015, which according to the petitioner, is in violation of the Jan Aushadhi Scheme”, the DB further said.
After considering the undertaking given by Sanyog Enterprises Pvt. Ltd, DB observed, “without prejudice to the other contentions, we are of the view that that the private respondent can also be allowed to pharmacy within the premises of Government hospitals”, adding “if the tender is confirmed in its favour subject to the condition that all the notified generic medicines should be made available for sale on demand from the patient on the fixed price”.
“If any violation is noticed, the licences granted to have pharmacy will be reviewed”, the DB directed.
