Srinagar, July 4: Jammu and Kashmir High Court today stayed fixation of seniority of about 50, 000 Rehbar-e-Taleem (ReT) teachers whose services will be regularized and their five years as ReT will be included in their service.
Justice Mohammad Yaqoob Mir after hearing counsel for petitioners (General Line Teachers) advocate Javed Iqbal said fixation of seniority of teachers whose services will be regularized is kept in abeyance.
“Questioning of fixing seniority vis-à-vis petitioners as well as the teachers whose services will be regularized in terms of the Government order No.469-Edu of 2014 dated:-25.6.2014, shall remain in abeyance, if not already fixed” the Bench directed.
Petitioners’ counsel advocate Javed Iqbal submitted before the court that the provision offends the rights of the petitioners.
“In addition thereto it runs contrary to the applicable service rules, extending the benefit of five years as Rehbar-e-Taleem on becoming substantive appointee as General line Teacher in favour of the ReT’s is per se illegal as such the order dated 25.6.2014 is liable to be set aside,” Iqbal argued.
Government last week issued an order under which five years service rendered by ReT teachers before regularization shall count for fixing their seniority.
A caveat application was filed by the ReT Forum through their general secretary and Public Secretary in this regard and their counsel submitted before the court that the ReTs are about 50, 000 in number and have served to the meager amount of Rs 1500 per month for years despite their high qualification and staying their seniority would adversely affect them.
The court after hearing their counsel said: “They have not been impleaded as party respondents but keeping in view the controversy involved they are impleaded as party respondents.”
The Bench also issued notice to the Government which was accepted by senior Additional Advocate General Javed Kawoosa and Additional Advocate General Shabir Naik for filing their response to the writ petition within two weeks.
