Court stays Executive Council elections of Amar Singh Club

JAMMU, Mar 8: Court has stayed the elections for Executive Committee, Amar Singh Club, Jammu till further orders.
Court of 2nd Additional District Judge-Jammu, in case of Sidharth Malhotra & others vs Amar Singh Club & others, set aside the order issued by Sub-Judge Jammu on March 2 where the appeal of Sidharth Malhotra was dismissed. The appellants had approached the court to stay the elections to elect new executive body of Amar Singh Club.
“Issue notice to other side for appearance, call for scanned record and in the meantime order dated March 2 passed by the court of Learned Sub-Judge, Jammu is stayed till next date of hearing and Secretary Amar Singh Club is temporarily restrained from taking any policy decision from conducting the elections of the executive committee till the next date of hearing”, says the Court Order.
The appeal was filed on March 6 by the appellants against the order dated March 2 passed by the High Court in the case titled ‘Sidharth Malhotra & others vs Amar Singh Club & others “, whereby the Sub-Judge, Jammu had dismissed the application of the appellants filed under order 39 Rule 1&2 CPC and prayer for setting aside the same.
Alongside the appeal, the appellants-applicants have also filed an application for interim relief. LC for the appellants-Applicants raised some arguable points, which were considered to be genuine, well-founded and need determination by the court. “On the basis of averments made, appellants-applicants have been successful to make out a prima facia case for indulgence at this stage because if order dated March 2, Jammu does not stay, the appellants-applicants will suffer irreparable loss and the present appeal may be rendered in fructuous, observed the court.
