Court raps Health Deptt

SRINAGAR, Mar 20:  The Jammu and Kashmir High Court today expressed anguish over the flouting of court orders on the appointment of top health officials of the Health Department including Director Health Services Kashmir.
The Division Bench of the High Court comprising Chief Justice M M Kumar and Justice Hasnain Masoodi pulled up the Health Department for giving a go bye to court orders over the appointment of Director Health Services Kashmir (DHSK), Saleemur Rehman, Chief Medical Officers (CMOs), Medical Officers (MOs), and Senior Consultants on regular basis.
The Court directed the Health Department to produce records of the candidates who had been considered for confirmation and appointment of Assistant Directors as well as Deputy Directors.
The court sought appearance of Secretary Health Services to explain his position regarding the non-implementation of court orders that have been issued from time to time.
The bench deferred the hearing after senior Additional Advocate General, Javaid Kawoosa, apprised that Secretary Health is in New Delhi till March 27 to receive the body of Kashmiri doctor who was killed in Libya.
The Health Department has sent only one name of Saleemur Rehman as the only eligible candidate for confirmation on post of Deputy Director.
“In order to satisfy the court, record has to be produced,” directed the court to the Health Department.
Advocate S L Hussain, counsel for the petitioner, Dr M Ashraf Bhat, Dr Saleem’s name has been sent for confirmation without fixing the seniority which is in violation of Article 14 and 16 of Constitution of India.
The court had earlier directed personal appearance of Commissioner Secretary Health for not implementing the court orders on promotions in Health Department. It had also directed the health authorities to comply with the Court orders and appoint DHSK.
