Srinagar, Apr 4: The Jammu and Kashmir High Court today quashed the promotion order of 176 Tehsil Supply Officers issued by Director Consumer Affairs and Public Distribution, Kashmir, in 2011.
Justice Ali Mohammad Magrey directed the CAPD to consider the employees from Kashmir Division, including Leh and Kargil districts.
“I am convinced that the impugned order numbers 43-DCA and PDK, 44-DCA and PDK, 45-DCA and PDK, 46-DCA and PDK of 2011 dated 31/3/011, issued by the CAPD director (respondent) have been passed and issued ignoring the claims of the petitioners. And therefore, are hit by the mandate of Article 14 and 16 of Indian Constitution and the service rules,” he observed.
The petition was filed by the 65 aggrieved candidates from Leh and Kargil districts who alleged that they were ignored by the department for promotion.
The court directed the these candidates be included in the fresh consideration within two months, adding that in case of any impediments found by the CAPD in promoting them, then the posts shall be made available to the respective Deputy Commissioners for further action.
The petitioners claimed through their counsel advocate S R Hussian that their two districts which are part of Kashmir division were excluded and ignored for being integrated into the seniority list.
Pulling up the CAPD, the bench observed that the department has thrown seniority norms to the wind and their rights deprived on flimsy grounds.
