JAMMU, July 4: In a revision petition filed by Choudhary Nagar Singh against the order of CJM Jammu whereby proceedings in a complaint against Basant Rath, the then SSP Jammu, Mubassir Latifi, the then SP, Abdul Rouf Lone, Kamaljeet Singh and Hardeep Singh Gill were dropped, Principal Sessions Judge Jammu, Kartar Singh today issued summons to police officers.
“In the instant case, it cannot be said that the rights of the respondents may not been affected by any adverse order if passed against them. The complaint filed by the respondent, which was rejected for whatsoever reasons may resurrect with a direction to the Magistrate to proceed with the complaint”, the Principal Sessions Judge said.
“Undoubtedly, whether the respondents were accused or not but their right would be affected by such order if passed, causing serious prejudice to them. Before passing any order, they are required to be heard as is the mandate of law”, the Court said and summoned Basant Rath, Mubassir Latifi, Abdul Rouf Lone, Kamaljeet Singh and Hardeep Singh Gill through IGP Jammu.
“The summons be sent to IGP for compliance through the Chief Prosecution Officer with a direction to ensure that they are served on the respondents without any excuse”, the Court said.
In the complaint, Nagar Singh has submitted that these police officers without the consent of the complainant (Nagar Singh) made a video film exhibiting complainant’s custodial interrogation in order to publically defame him by transmitting the video film in the internet.
