Court grants 7 days transit remand of Parra

JAMMU, Jan 11: Special Judge NIA Court Sunit Gupta today granted seven days transit remand of PDP leader Waheed-ur-Rehman Parra and Mukhtyar Ahmed Waza alias Munir Ahmed Sofi, who were arrested by the CIK.
According to the remand application, Police Station CIK Srinagar has registered an FIR No. 31/2020 for the offences under Sections 13/17/18/38/ 39/40 UA (P) Act read with Sections 124-A/120-B/ 121/121-A IPC on the basis of the information received from reliable and confidential sources that some political functionaries were misusing their membership, position or affiliation and as a part of criminal conspiracy, they have established clandestine connections and relations with different Pakistani terrorists and secessionist organizations operating in J&K.
Taking advantage of the cover available to them because of their membership or position or affiliation with the political parties, these unscrupulous political parties functionaries have variously supported the terrorists and secessionists directly and sometime through middleman, by way of paying money, organizing select physical attacks through terrorists elements, facilitating their movements, transporting their fighting hardware and importantly saving them from range of legal and coercive actions of law enforcement agencies.
On the basis of this information from reliable source, the FIR was registered and investigation was set into motion by Police Station CIK, Srinagar. During the investigation, the Investigating Agency got search warrants issued from Chief Judicial Magistrate Srinagar against the present accused persons.
Accordingly, searches were conducted on the residential house of the accused Waheed-ur-Rehman Parra and two houses of the accused Muneer Ahmed Sofi, son of Mohd Subhan Sofi one at Bijbehara and other at Bathindi Sunjwan, Jammu. During the search operation, the investigating agency recovered incriminating material whereby the complicity of both the accused persons was established in the present case.
Since the matter falls within the territorial jurisdiction of the Special Judge under Section 22 NIA Act at Srinagar and due to the prevailing weather condition it would not be possible for the investigating agency to produce the accused persons before the concerned Special Judge, as such, the transit remand for seven days was sought.
After considering the prayer made by the Investigating Officer, the court said, “the prayer made by the Investigating Officer is genuine as such transit remand of the accused persons for a period of seven days is granted”, adding “the Investigating Officer is directed to produce the accused persons before the Special Judge of the competent jurisdiction on or before January 18”.
