JAMMU, Nov 1: Principal Sessions Judge Jammu, R S Jain today discharged an alleged narco smuggler namely Ramesh Kumar, son of Manga Ram of Rehari Colony at the stage of framing of charges.
After hearing both the sides, Principal Sessions Judge observed, “there is no evidence on record more so the report of the public analyst to show that the articles allegedly recovered from the possession of accused person contained drugs which violates the provisions of NDPS Act”.
“From the date of filing of challan, prosecution has been unable to file the report of the FSL which would show that the articles seized from possession of accused contained drugs so as to make out a prima facie case against the accused for offences under the NDPS Act. Thus the allegations against the accused are based on conjectures and surmises which have no basis”, the court said.
Accordingly, accused Ramesh Kumar was discharged.
