Court directs SHO Domana to proceed under law

JAMMU, July 29: Judicial Magistrate 1st Class (Munsiff), Jammu, Preet Simran K Grover has directed the SHO Police Station Domana to look into the alleged encroachment of cremation ground at Lower Barnai and proceed under law.
The direction was passed in an application filed by Pradeep Singh of Lower Barnai through Advocate Irtiza Mushtaq seeking appropriate directions to the SHO to register an FIR against the accused Ranjeet Singh, Angrez Singh, Yashpal Singh and Sham Singh, all sons of Chanchal Singh of Lower Barnai under Section 447, 379, 295-A and other relevant Sections of Indian Penal Code for grabbing portion of cremation ground.
During the course of arguments, Advocate Irtiza Mushtaq submitted that on 16-08-2016 Tehsildar Jammu North with other concerned revenue officials and with the assistance of local police demarcated and evicted the accused persons and some other locals from the encroached land.
It was also submitted that after 16-08-2016 till 19-10-2019, the land was in the legal possession of cremation ground but on 19-10-2019 the accused persons again illegally and forcefully encroached the cremation ground.
On 05-03-2020 the applicant along with other locals of village Lower Barnai filed an application before SHO Police Station Domana for registration of FIR against the accused persons and a copy of the same was also sent to DC Jammu. However, no FIR was registered compelling the applicants to know the doors of SSP but till date neither any action has been taken nor FIR registered.
After considering the submissions of Advocate Irtiza Mushtaq, JMIC (Munsiff) Preet Simran K Grover issued directions to SHO Police Station Domana to look into the matter immediately and proceed under law.
The court further directed that a copy of the order be also sent to SSP Jammu for information.
