Court directs registration of FIR

Fraud with Solan based company

JAMMU, Feb 4: Special Mobile Magistrate Susheel Singh has issued directions for registration of FIR in connection with the fraud committed with a company on the name of AIIMS Jammu project.
The case before the court was that accused namely Rajneesh Thapa and his accomplices duped senior citizen namely Kamal Singh Dhiman, who is a partner in an electrical contract company namely M/s Dhiman Electrical Company of Nalagarh Distt Solan in HP on the name of AIIMS Project Jammu.
After hearing Advocate Aseem Sawhney and going through the story as how a while collared fraud was committed with complainant Kamal Singh Dhiman and his company, the court directed the SHO Police Station Gandhi Nagar to register an FIR against Rajesh Thapa of Kartholi and other accused.
It was submitted before the court that the complainant is the victim of fraud, cheating by forgery and impersonation at the hands of the accused Rajneesh Thapa who had duped the complainant of an amount of Rs 10,17,590. When the complainant asked for return of the money the accused stopped taking the calls and dilly dallying the complainant on one pretext or the other thus making it clear that the accused has actually defrauded the complainant on the name of getting the contract of under construction -AIIMS electric work orders for the complainant.
After hearing these submissions of Advocate Aseem Sawhney, the court observed, “the averments made in the application prima facie constitute serious allegations and are cognizable by Police but Police has failed to register an FIR and thus the SHO Police Station Gandhi Nagar Jammu is directed to lodge FIR and investigate the matter in terms of Section 156 (3) of CrPC and in light of Supreme Court Judgments in Lalita Kumari and Priyanka Srivastava’s judgments”.
The court further directed that the copy of application be sent to the Police Station for compliance.
