JAMMU, Apr 20: Chief Judicial Magistrate Reasi Amarjeet Singh Langeh has rejected the bail application of one Shakeel Ahmed, son of Abdul Hamid of Reasi who was booked for insulting National Flag.
While hearing bail application through virtual mode, the CJM observed, “the result of investigation carried forward hitherto would also show that the origin of the Facebook post in question is from Pakistan. Sheer fact that the post forming subject matter of case against petitioner being overwhelmingly apparent in showing indignity and insult to the Indian National Flag (Tri-colour) – ought to have evoked exacting scrutiny by petitioner as to the content thereof and desirability of its being posted on his Facebook ID”.
“Petitioner, however, seems to have posted the material on his Facebook ID consciously and intentionally thereby demonstrating not only his complicity in stripping of the symbolic value of Indian National Flag but also his brazen disregard for potential consequences that can reasonably ensue once the circulation of the post is viewed by onlookers/ audience on his Facebook”, the court observed.
“Imagine the scale of disturbance if this post is taken as incitement by public at large and anger is stirred up. Petitioner does not seem to be naive enough to be oblivious of these potential consequences linked to his act. Modus operandi employed by petitioner therefore ex-facie gives a whiff of his intention to perpetuate offences alleged”, the court further observed, adding “prima facie prosecution has made out a case of involvement of petitioner in the offences for which he stands booked”.
With these observation, court rejected bail application.
