Court denies bail to accused in fake H&ME website case

SRINAGAR, Nov 30: A court today rejected the bail application of a person involved in creating a fake website for the Department of Health & Medical Education (H&ME).
City Magistrate, Fozia Paul, while hearing the case, stated that considering the initial stage of the investigation and the magnitude of the case, the bail application is “rejected.”
According to the police report, the accused, Sajad Hussain Zargar, son of Mohd Yousuf Zargar, residing in Hamdania Colony, Bemina Srinagar, has been arrested in connection with FIR No. 16/2023 of P/S Cyber Police Station Kashmir Zone Srinagar for offenses under Section 66-D of the IT Act, 34, 120-B, 468 IPC.
As per details, a complaint received by the police station from the Deputy Secretary to the Government Health & Medical Education Department prompted the registration of FIR.
In the complaint, it was alleged that a clone/fake commercial website with the URL https://Jk-gov.com had been created in the name of the Health and Medical Education Department by unknown persons.
The complaint stated that the data/interface from the official website of the Health and Medical Education Department under the URL://hime.jk.gov.in had also been cloned.
Fake orders referencing the Health and Medical Education Department UT of J&K were created and uploaded on the website, details of which have been provided before the court.
“Taking note of all the facts and high magnitude of the case and the fact that the investigation in the matter is at its initial stage, I opine, that if at all the accused is released on bail at this stage, the same would frustrate the investigation as well as shake the confidence of the general public in the judicial system,” City Magistrate noted in an order issued in this regard.
She further stated that keeping in view the entire factual matrix and the material on record, “the accused person at this stage is not entitled to the concession of bail, and as such, the instant bail application is ‘rejected.'”
