JAMMU, Oct 14: Presiding Officer Fast Track Court Kishore Kumar today rejected the bail applications of Jatinder Singh of Sainik Colony, Sanjay Kumar of Akhnoor and Swarna Kumari of Qasim Nagar, who were involved in much publicized Channi Himmat gang rape case.
According to the police report, on 26.09.2016, prosecutrix filed a written report alleging that she is a student of Jammu University and putting up at Qasim Nagar on rent basis. During the intervening night of 25/26th of September, Swarna Devi, wife of Ashok Kumar took the prosecutrix to her room located at Channi Rama where she found three persons namely Sanjay, Jatinder and Bubby, who forcibly committed gang rape with her.
After the commission of offence, all the accused persons fled away from the spot after locking the prosecutrix in a room. On next day, prosecutrix managed to open the door and thereafter she filed the complaint. On this report, a case for the commission of offences under Sections 376, 120-B RPC was registered and the investigation commenced.
After hearing Advocate D K Khajuria appearing for the applicants whereas Advocate AK Sawhney with Advocate Aseem Sawhney for the complainant, Presiding Officer of Fast Track Court observed, “it is true that the act of rape rears its ugly facade almost every day. As per the National Crime Bureau, in India, a rape is committed after every 20 minutes”.
“Rape being the fastest growing crime is undoubtedly one of the most terrible, belligerent and atrocious act committed against the dignity of a woman. Rape has been held to be more serious than the murder. Rape lays a permanent scar on the life of the victim”, the court observed.
Accordingly, court rejected the bail application.
