Court awards one month imprisonment, Rs 500 fine in theft case

UDHAMPUR, Jan 23: Judicial Magistrate 1st Class Chenani, Sumati Sharma today awarded one month simple imprisonment and Rs 500 fine on the accused involved in theft case.
According to the case, on March 31, 2016, a complaint was filed by Jyoti Devi with Police Station Chenani stating that at about 5:30 pm a person identified as Wali Din, son of Yogi, a resident of Uttar Pradesh snatched her mobile phone and cash from outside her house.
Acting on the complaint, a case was registered and investigation started and the accused was nabbed by the police.
After completion of investigation, challan under Section 382 RPC was presented in the court of law.
After hearing PO Pallavi Kesar for the state and Learned Defence Council for the accused, the court observed that although the accused had been charged for the commission of office under Section 382 RPC, yet the evidence brought by the prosecution disclose the commission under Section 378 RPC, so a simple imprisonment of one month has been awarded to the accused and fine worth Rs 500.
