Court awards life-imprisonment to 3 in DyAG murder case

Jammu, July 9: 1st Additional Sessions Judge Jammu YP Kotwal today decided 12 years old murder case of Ajit Dogra then Deputy Advocate General and awarded life-impriosnment to three accused namely Vishal Sharma, Ashok Kumar and Amrish Khajuria.
According to the prosecution case on January 10, 2008, while Shiv Dev Singh S.I along with other Police personnel was on patrolling duty in Muthi area, one person namely Manga Ram son of Kirpa Ram of Udheywalla (PW-1) lodged a verbal report regarding attack on Ajit Singh Dogra (the then Deputy Advocate General), by Vishal Sharma, Vikas Sharma sons of Krishan Kumar Rohit Kumar son of Ranjit Kumar, Labha Ram son of Karam Chand, Ashok Kumar son of Banarsi Dass and three other persons. During the investigation investigation it was established that accused Vishal Sharma, Labha Ram alias Sanjay , Ashok Kumar alias Shoka were jointly doing the business of property. They had sold the land of Haqiqat Raj son of Munshi Ram of Udheywalla after preparing fake sale deeds. Aggrieved by the same, Ajit Singh Dogra Deputy Advocate General had filed a case against them in the Court. So, they had hatched a criminal conspiracy to eliminate Ajit Singh Dogra. They also hatched conspiracy with Gourav Sharma, Amrish Khajuria alias Max, Raj Kumar alias Raju (deceased now) and Mohan Singh alias Mohna for commission for eliminating the deceased, as such on 10.01.2008, they with common criminal intention to commit murder of Ajit Singh Dogra.
After completion of investigation challan was presented in the Court.
1st Additional Sessions Judge Jammu YP Kotwal after hearing APP Harminder Singh for the Prosecution observed that the guilt stands proved against accused Vishal Sharma, , Ashok Kumar, and Amrish Khajuria beyond all shadow of doubt. Thus accused Vishal Sharma is proved to have committed offences punishable under section 302 RPC, 34 RPC, 341- 34 RPC, 30 ARMS Act, Ashok Kumar is proved to have committed offences punishable under section 302, 341, 34 RPC, whereas Amrish Khajuria is proved to have committed offences punishable under section 302, 341, 34 RPC and 4/25 Arms Act. They are accordingly convicted for the commission of said offences. However, the prosecution has miserably failed to proved its case beyond all shadow of doubt against accused Labha Ram, Gourav Sharma and Mohan Singh, as such they are entitled to benefit of doubt, they are acquitted of the offences with which they have been charged.
Court after hearing both the sides observed that convict Vishal Sharma is sentenced to life imprisonment and fine of Rs. 10,000 for commission of offence punishable u/s 302 RPC simple imprisonment for one month and fine of Rs. 500 for offence u/s 341 RPC. Six months simple imprisonment and fine of Rs. 2,000 for offence punishable u/s 30 Arms Act, convict Ashok Kumar is sentence to life imprisonment and fine of Rs. 10,000 for commission of offence punishable u/s 302 RPC simple imprisonment for one month and fine of Rs. 500 for offence u/s 341 RPC whereas convict Amrish Khajuria is sentence to life imprisonment and fine of Rs. 10,000 for commission of offence punishable u/s 302 RPC simple imprisonment for one month and fine of Rs. 500 for offence u/s 341 RPC. Two months simple imprisonment and fine of Rs. 2,000 for offence punishable u/s 4/25 Arms Act. The sentence shall run concurrently.
