JAMMU, Feb 15: Principal Sessions Judge Jammu Vinod Chatterji Koul has awarded 3 years rigorous imprisonment to a Bangladeshi namely Mohd Sohail Choudhary under 14 FA Act 2004.
The Bangladeshi was nabbed by Police Station Arnia on July 22, 2016 after he was found roaming in the border area under suspicious circumstances.
After hearing Public Prosecutor Rakesh Badyal for the State, the court observed, “from the oral and documentary evidence produced by the prosecution it is established beyond doubt that accused was found moving in a restricted area without having obtained any permit for such movement”.
“Accused was found moving in the area which fall within the protected area for which he was required to obtain permit from the competent authority—Central Government or any officer authorised by the Central Government in this behalf”, the court said, adding “in this way he has violated Section 14 A of Foreign (Amendment) Act 2004”, the court said.
Accordingly, court awarded three years RI to the accused.
