Court awards 10 yrs RI in minor’s rape case

UDHAMPUR, Oct 25: Principal Sessions Judge Udhampur, A K Koul today awarded 10 years rigorous imprisonment and fine of Rs 5000 to accused Farooq Ahmed alias Kala, son of Fazal Din of Mand for committing the rape of minor.
According to the police case, on July 17, 2005, the prosecutrix, who had gone to a nearby shop to purchase some articles, was lured by the accused by paying Rs 5 to nearby bushes and raped her there. Accordingly, a case was registered.
Later, the family members of the accused started threatening the family of prosecutrix and on the intervening night of July 19 and 20, 2005, the accused and his associates barged into the house of prosecutrix and assaulted her family members. On this Sections 458, 147, 148, 323 and 201 RPC were added in the FIR and after completion of investigation challan was presented in the court of law.
After hearing Public Prosecutor Navneet Gupta for the State whereas Advocate Ch Mohd Shafi for the accused, Principal Sessions Judge Udhampur observed, “the accused has committed such a grave crime which in every section of the society is considered to be a shocking one”, adding “a minor prosecutrix has become the victim of the lust loaded criminality of accused. A rape is always a life long trauma for a victim and no punishment or compensation can lessen the pain and agony, which the victim has to face along with her entire family”.
“The Court does not see any reason to take a lenient view against the accused in so far as the question of sentence is concerned”, the Principal Sessions Judge said while convicting the accused, who was awarded 10 years imprisonment and fine of Rs 5000 under Section 376 RPC.
