JAMMU, Mar 6: Principal Sessions Judge Udhampur, A K Koul today awarded ten years rigorous imprisonment and fine of Rs 50,000 to accused Sat Pal, son of Tej Ram of Krimchi, who attempted to kill the girl for not accepting his proposal for marriage.
According to the police case, accused was coercing Rajni Devi was marriage with him but the proposal was rejected by her. On this accused developed hatred towards her and on October 16, 2009 the accused chopped off the arm of Rajni Devi by using sharp edged weapon.
After hearing Public Prosecutor Navneet Gupta appearing for the State whereas Advocate K B Gupta for the accused, Principal Sessions Judge observed, “the accused does not deserve any leniency keeping in view the magnitude of the crime committed by him. There was a time when women were worshiped. Gradually their status deteriorated on account of historical and social compulsions. Male dominant society has reduced them to meek entities”.
“Crime against women is on rise. So urgent steps are required to be taken to put down the crime and violence against the women. A healthy public opinion needs to be created against the undesirable criminal activities. It is almost a beaten law now that the punishment must be proportionate to the crime committed by an accused but then we need to remember that taking away the liberty of an accused for life is a serious issue and so deserves a cautious consideration”, the Court said.
“Life without liberty is virtually a body without the soul. Accused is around 29 years old and detaining him for life would mean curtailing his liberty till he is alive or till he earns a remission. Undoubtedly the crime committed by him is grave but looking at the age of the accused I suppose he deserves slightly lesser punishment than the maximum provided for the offences committed by him”, Principal Sessions Judge said.
Accordingly, the accused was awarded rigorous imprisonment for 10 years and also fine of Rs 50, 000. Similarly accused was sentenced to rigorous imprisonment for one month for commission of offence under Section 341 RPC.
