Court acquits Lab Asstt as prosecution fails to prove case

JAMMU, Dec 15: In the case of misappropriation of over Rs 1 lakh, Principal Sessions Judge Ramban, M A Choudhary has acquitted Zakir Hussain, son of Ghulam Mohd of Anantnag as prosecution failed to prove its case.
According to the police case, Principal Government Higher Secondary School Ramban moved a written complaint on November 23, 1998 alleging therein that on his taking over as incharge Principal on September 1, 1998 he had directed all the incharge local funds to produce their cash books and cheque books for scrutiny.
On October 30, 1998, Zakir Hussain presented Cash Books of school improvement fund, poor fund, social activity fund, science fund and Red Cross. However, the cashbooks were found outwardly complete and duly signed up to ending August 1998. During the course of verification from Jammu and Kashmir Bank, Ramban branch, it came to fore that Zakir Hussain had made fraud entries in passbooks and cash books in his possession.
The pay arrears of Master Bansi Lal and retired Lecturer H K Boni amounting to Rs 25,000 drawn from Ramban Treasury by Zakir Hussain had not been disbursed from the account of the institution in J&K Bank Ramban. Further the admission fee of 9th and 10th classes had also been not deposited in the treasury. In this way, Zakir Hussain embezzled more than Rs one lakh.
Ramban Police conducted investigation into the complaint of Principal and after completion of probe presented challan in the court of law.
After hearing both the sides, Principal Sessions Judge Ramban observed, “the prosecution has failed to bring home the charge against the accused for want of cogent, credible and trustworthy evidence”.
With these observations, court acquitted the accused of the charges.
