Court acquits KZF militant after 15 yrs long investigation, trial

JAMMU, Oct 4: Principal Sessions Judge Jammu, Jang Bahadur Singh Jamwal today acquitted alleged militant of Khalistan Zindabad Force (KZF) as prosecution failed to prove its case.
According to the police case, KZF militant namely Tej Paul Singh, son of Sohan Singh, resident of Sector No.3 H.No.569, F Nanak Nagar was apprehended by Gandhi Nagar Police as soon as he entered the State for carrying out terrorist activities. During interrogation, he disclosed that he had kept concealed AK 56 rifle, five magazine, 109 cartridges in his house. Accordingly, the arms and ammunition were recovered and after completion of investigation challan was presented in the Court of law.
After hearing both the sides, Principal Sessions Judge observed, “admittedly the FIR came to be lodged by SDPO Gandhi Nagar Jammu. However, he was never produced and examined by the prosecution to establish whether any FIR came to be recorded. The statement made by him has been hit by Section 24 of Evidence Act”.
“The statement made by accused cannot be admissible because same has not been recorded as per Section 27 Evidence Act. There is no evidence on record to connect the accused with the commission of offences and the prosecution has failed to prove its case”, the Court further observed and acquitted the accused of the charges leveled against him.
