JAMMU, July 20: Principal Sessions Judge Jammu, Kartar Singh has acquitted alleged ISI/FIU agents Javid Iqbal, son of Mohd Amin Malik of Thanamang, Darhal and Vikas Sharma, son of Saroop Chand Sharma of Shitli Khanpur Nagrota as prosecution miserably failed to prove the case.
According to the police case, on May 5, 2009 an information was received at Joint Interrogation Centre that Pakistan secret agency ISI and FIU have contacted some persons in Jammu & Kashmir and through them they are watching the activity of Indian Army, BSF and Police in order to cause disturbances in India as well as in J&K.
During investigation, the accused Javid Iqbal Malik and Vikas Sharma were found roaming in Jammu city in a Tata Sumo, which was intercepted near Jewel Chowk, and the accused were taken into custody. From the personal search of the accused Javid Iqbal one China made mobile, two SIMs of Airtel were recovered, whereas from the personal search of the accused Vikas Sharma mobile phone, SIM and three site plans of vital installation of the Indian Army were recovered.
During investigation, the accused Javid Iqbal Malik deposed that he used to chat through e-mail with the officer of ISI and FIU code name Umar Rashid and he supplied information to them regarding Indian Army. The information was supplied through a computer from a shop which is situated at Bus Stand Darhal. On this information, four CPUs, one laptop, NDC of the accused, copy of the movement order and passport of Jahangir Malik were recovered.
During further investigation, it came to fore that the accused Javid Iqbal at the instance of his brother went to Pakistan in the year 2005 in order to meet his relatives, where his visa was extended and during this period the accused got training in arms and ammunition. He even met the officers of ISI and FIU code name Umar who directed him to keep an eye on the movement of Indian Army.
After hearing Advocates Rajneesh Oswal and Rohit Sharma appearing for the accused persons whereas Public Prosecutor Shabir Choudhary for the State, Principal Sessions Judge observed, “prosecution has miserably failed to prove its case against the accused beyond doubt. They are, therefore, acquitted of the charges framed against them”.
