Accused acquitted of charges

JAMMU, Sept 10: The Fast Track Court, Jammu today acquitted accused Vishal Singh who was facing trial in the charges of abduction and rape. Allegations against him were that while complainant left Nanak Nagar, Jammu for her parental house on 24.04.2018 and when she reached her parental house at Gho -Manasa, three boys came in a car and forcibly abducted her while she was walking on foot, took her to a room and raped her for four days.
She was allegedly let off on 30.04.2018 at Bhori Chungi where she contacted her brother who took her to her parental house at 11’o clock in night and thereafter FIR was registered on written complaint of prosecutrix on 02.05.2018. After investigation, Challan was presented on 31.07.2018 and thereafter charges against accused for offences of abduction and rape were framed on 14.08.2018 who pleaded not guilty. Remaining two boys could neither be traced nor any evidence was found against them.
Evidence however, showed that prosecutrix had a relationship with the accused which continued even after her marriage, a fact which she did not mention in her complaint based on which FIR was registered. Further, even her brother and father did not support her version in the court when examined as prosecution witnesses.
Observing that even father of prosecutrix did not support her version, court held “Suffice it to say that the manner in which father of complainant sheds light on her embarrassing conduct-only under cuts the truthfulness of prosecution case.”
Astonishingly also, Investigating Officer testified in the court that as per his investigation accused and complainant obtained on rent a room owned by one Mohammad Amin where they stayed from 26.04.2018 to 29.04.2018 by posing themselves as husband and wife. “If prosecutrix and accused posed as couple and stayed in room for four days, then where is the occasion for abduction and rape” underlined the court by further observing that this factor is the last nail in the coffin of prosecution case exposing its falsehood.
With these observations court dismissed the challan and acquitted the accused.
