JAMMU, Jan 27: In a controversy over whether Directorate of Urban Local Bodies is a Government organization or not, a bench of Central Administrative Tribunal (CAT) comprising Dr Bhagwan Sahai and Rakesh Sagar Jain has directed Secretary, Department of Housing and Urban Development to submit written reply clarifying the position.
The significant order has been passed in a petition filed by one Jeet Singh seeking release of salary. When the matter was taken-up on last date of hearing, CAT, after hearing both the counsels, had directed Deputy AG to file reply of the respondents clarifying the position as to whether Directorate of Urban Local Bodies is a State Government organization or not.
Deputy AG Rajesh Thapa submitted that as per the instructions, Directorate of Urban Local Bodies is not a State Government organization, it is an organization set up by ULBs themselves, and, therefore, the applicant employed by the Director of Local Bodies is not employee of the State Government.
After hearing Senior Advocate Rahul Pant for the petitioner whereas Deputy Rajesh Thappa for the UT, the CAT observed, “we are not convinced of Deputy AG’s submissions”. Accordingly, the CAT directed him to submit a written reply from Secretary, Department of Housing and Urban Development clarifying as to whether the Directorate , Urban Local Bodies is a State Government organization or not.
