JAMMU, Apr 9: Chief Judicial Magistrate (CJM) Jammu Amarjeet Singh Langeh today took serious note of non-compliance of the directions by the Crime Branch and directed the SSP to file compliance report before next date of hearing.
“The complainant invoked Section 156(3) of CrPC for registration of FIR by Crime Branch for offences involving forgery and SSP Crime Branch Jammu vide order dated 15.03.2021 asked for registration of FIR”, the CJM said.
“On 29.03.2021, a report was submitted by Deputy Superintendent of Police Crime Branch Jammu through prosecution that preliminary enquiry into the matter has been initiated which will be concluded on its merits”, the court said, adding “once SSP Crime Branch was under categoric direction to register the FIR in terms of Section 156(3) of CrPC in the matter and proceed with the investigation by deputing responsible officer, the course adopted by the Crime Branch to initiate preliminary enquiry, seemingly – un¬mindful of direction under 156(3) of CrPC is indeed an aspect whose rationale needs to be clarified by the Crime Branch”.
Accordingly, court directed SSP Crime Branch to do needful before next date of hearing.
