Death of infants due to spurious drugs in Ramnagar

JAMMU, Apr 22: In the much publicized case of death of infants due to spurious drugs in Ramnagar area of Udhampur district, Chief Judicial Magistrate (CJM) Jammu Amarjeet Singh today issued bailable warrants of Digital Vision, Manufacturing Company, Himachal Pradesh and others.
The other persons are Parshotam Goyal, Konic Goyal, Manic Goyal, Rita Goyal (Partners), Anuj Kumar Singh (Deputy General Manager), Yogesh Bhasin (Manufacturing Chemist). Sudhir Kumar (Analytical Chemist), Parshotam Goyal (Competent Person), Virinder Kumar Jandyal , son of Ram Ditta of Lakhar Mandi Janipur and Mohinder Singh, son of Bharat Singh of Ramnagar.
The complaint was instituted on 01.07.2020 seeking prosecution of accused for offences under Sections 16, 17A(e), 18(a)(vi) 18 (a) (i), read with Sections 27(a), Section 27(d) 36AC of the Drug & Cosmetics Act, 1940.
During investigation it came to the fore that infant mortalities in Ramnagar area of district Udhampur occurred due to consumption of medicine/drugs which were purchased from one retail drug store under name of Jamwal Medical Hall being operated by Mohinder Singh. On 17.02.2020 samples were also lifted from Jandial Pharmaceuticals, Mohalla Paharian, Jammu who is whole sale license holder and distributor for analysis to Chandigarh where the drug sample namely “Coldbest-PC Syrup”, Batch No. DL5201 was found to be “not of standard quality”.
During further investigation, it was found that the drug in question is not only of “not standard quality” but also adulterated one.
After going through the complaint, the CJM observed, “drug products including drug in question that are intended for use of public at large must meet their standards of safety and quality consistent with the provisions of Drugs and Cosmetics Act”.
“In the complaint in hand, there is prima facie evidence of infraction of provisions of Act and hence this complaint under Sections 16, 17A (e), 18(a)(vi) 18 (a) (i), read with Sections 27(a), Section 27(d) 36AC of the Drug & Cosmetics Act, 1940 for which cognizance seems to have already been taken by this court on 01.07.2020 and process issued against accused”, the CJM said.
CJM further observed, “having regard to the gravity of the offences involved and seriousness of the allegations, it is directed that accused to be summoned through issuance of bailable warrants in the amount of Rs 20,000 each for appearance before this court on next date of hearing so that after performing preliminary formalities, matter can be committed to the Special Court for trial”.
“The counsel for complainant shall ensure that particulars of all accused with respect to the districts in which they are presently residing be furnished to this court within four days from today so that the bailable warrants can be sent to concerned SSP(s) for execution at the earliest”, CJM added.
