SRINAGAR, Aug 1: The Chief Judicial Magistrate Srinagar today granted 24 hours to the Senior Superintendent of Police Srinagar for filing of an FIR against a police officer in case of killing of a man in Batamaloo area of Srinagar on July 10. The court warned him framing of rules under contempt if he fails to comply.
The SSP Srinagar was brought under custody of DIG Central Kashmir before the court of Chief Judicial Magistrate Srinagar, Masarat Shaheen, this afternoon. He submitted a bail and personal bond to the tune of Rs 50,000 each in lieu of non-bailable warrants against him before the court.
The SSP Srinagar sought time from the court for filing of statement of facts and court granted him time till tomorrow to comply with the directions of the court which had been passed on 18.7.2016 and 28.7.2016 on lodging of a FIR against the DySP, Yasir Qadri.
Trial court also directed SSP to file the copy of FIR within 24 hours before the court and warned him that in case he fails to comply with the orders then rule under contempt of court will be framed against him and it will be referred to High Court for punishing him (SSP) under law. “SSP is further directed to remain present before court on tomorrow and file the compliance report personally”, directs the CJM court.
In the meantime, Jammu and Kashmir High Court did not grant any interim relief to DySP Yasir Qadri in a petition filed by the State (Police) challenging the order of trial court whereby SSP Srinagar was directed to lodge FIR against his subordinate for alleged involvement of killing of youth.
Justice Mohammad Yaqoob Mir today deferred the hearing of the case by tomorrow on 2.8.2016 as the State counsel submitted that the case is prima facie strong for interim relief in view of various judgments of Supreme Court and High Court.
The State is seeking stay of trial court orders (dated 18.7.2016 and 28.7.2016 passed by the Chief Judicial Magistrate Srinagar) wherein SSP Srinagar was directed to lodge FIR against the Deputy Superintendent of Police Yasir Qadri in alleged involvement of killing of youth in Batamaloo area of Srinagar.
On 18.7.16 SSP was directed to lodge FIR against the DySP and on 28.7.2016 he was again directed to lodge FIR within 2 two days otherwise remain present before the court to explain why FIR is not registered despite court directions.
Father of Shabir Ahmad, the youth who was killed in police firing at Tengpora Batamaloo, in its application has submitted that the DySP took law in his own hands and killed his son in cold blood without any reason and rhyme. He has submitted that he filed an application with the SHO Batamaloo who refused to lodge an FIR against the DySP.
