JAMMU, Oct 18: CJM Jammu, S R Gandhi today rejected the bail application of one Mohd Ashraf, son of Abdul Gani of village Seohra, Jammu, who has allegedly committed rape of his minor step-sister.
After hearing CPO Harminder Singh for the State, the CJM observed, “rape undoubtedly is a serious offence and it gets further aggravated when committed upon a minor like prosecutrix, who has not yet completed her 15 yrs”.
“The public interest as such is involved in this case and the case is required to be dealt sternly and unbendingly. In case accused person is released on bail at this stage, there is every-likelihood of accused being the step-brother of the prosecutrix influencing/ threatening the prosecution witnesses who most probably can be his family members resultantly hampering the investigation”, the Court further observed
With these observations, Court rejected the bail plea of the accused.
