CJ launches Common Mechanism for Compromised Settlement of TP claims

JAMMU, Dec 6: Chief Justice of State High Court, Justice M M Kumar today formally launched “Common Mechanism for Compromised Settlement of TP Claims” devised by four PSU Non-Life Insurance Companies for the speedy settlement of third party motor claims.
Justice Hasnain Massodi, Judicial Officers, Senior Advocates and police officers were among those who attended the launching ceremony.
Speaking on the occasion, Chief Justice lauded the endeavour of PSU Insurance Companies and advised them to concentrate in formulating a Scheme for providing immediate Medical Aid to the victims of the motor accidents so that the precious human lives are saved. He further advised the PSU Insurance Companies for providing training and education to the drivers about the driving norms.
The Chief Justice also advised the PSU Insurance Companies not to leave any stone unturned to bring efficiency in ameliorating the pain and sufferings of the victims of motor accidents.
Earlier, Atul Jerath, Deputy General Manager, Oriental Insurance Company presided over the function and he, while introducing the Scheme, stated that a committee comprising a retired District Judge, a Retired Senior Medical Officer (Orthopedics) and a Senior Officer from a Public Sector Insurance Company would decide the quantum of compensation to be paid to the victims of the motor accidents.
The cases agreed for settlement would be placed before Lok Adalat constituted for the purpose and recorded as settled, after which the compensation amount will be released within 30 days. It was also informed by Atul Jerath that on trial basis a Lok Adalat was organized by Chairman, District Legal Services Authority, Jammu, Jang Bahadur Singh Jamwal, who is also Principal District and Sessions Judge, Jammu, on December 3 and December 4, 2012 wherein 27 cases were settled for an amount of Rs. 62.57 lakh.
The Chief Justice handed over the cheques to the victims of the motor accidents.
On the occasion, Jang Bhadur Singh Jamwal, Principal District and Sessions Judge, Jammu was presented a memento by A K Das, Deputy General Manager, Oriental Insurance Co. Ltd. for his meritorious services rendered in mitigating the sufferings of the victims of motor accidents. Advocate D S Chauhan was also given memento for extending helping hand to Insurance Companies in organizing Lok Adalat and taking up the cause of the victims of motor accidents for assessing just compensation.
