CJ directs State to implement SHRC direction wthin 8 weeks

JAMMU, May 16: Chief Justice of High Court today directed the State to implement the directions of State Human Rights Commission (SHRC) within a period of eight weeks.
The direction was passed in a petition filed by Shakeela Akhter, whose brother (a surrendered militant) was killed by unidentified gunmen in the year 1994. The petitioner prayed for issuance of directions to the Chief Secretary for implementation of judgment of SHRC whereby State Government was directed to pay ex-gratia relief of Rs one lakh in favour of next of kin of deceased and extend benefit of SRO-43 in favour of eligible member of the deceased’s family.
The State Human Rights Commission itself forwarded the copy of the order dated 09.03.2012 to the State Government through Chief Secretary, Commissioner Secretary (Home) and Deputy Commissioner, Anantnag for action taken report within a stipulated time. When no action was taken till December 2012, the petitioner filed writ petition on 29.12.2012.
After hearing Advocate Bilal Ahmad Malla for the petitioner whereas AAG BA Dar appearing for the state, Chief Justice directed the Chief Secretary to implement the order of the State Human Rights Commission within a period of eight weeks from the date of receipt of copy of this order.
