CIC castigates R&B for non compliance of RTI provisions

JAMMU, March 8: Castigating Road and Building Department for not showing due regard and compliance with the provisions of State RTI Act, the State Chief Information Commissioner G R Sofi has sought explanation of two Executive Engineers of the department for initiating penalty proceedings against them.
The observation against R&B has been made in two separate cases, filed before the Commission as second appeal by RTI activists, who were furnished incomplete information by concerned PIOs and the First Appellant Authority.
Under the RTI, information was sought from X-En Khanabal and X-En Shopian, who were PIOs, about Khudwani Sangam Road and illegal acquisition of land at village Kuchpora in Pulwama, respectively.
As the PIOs did not furnish complete information, the appellants filed a first appeal before the concerned Superintending Engineers, the First Appellant Authority, who also failed to pass the order within prescribed time. Following this, the appellants approached   the Commission vide second appeal.
The Commissioner has asked X-En Khanabal Bashir Ahmed Bhat and X-En Shopian, Kashmir to explain why penalty proceedings as provided under Section 17 of the State RTI Act may not be initiated against them for giving incomplete and incorrect information. Asking the Registrar to initiate summon proceedings against X-En Shopian and his SE, the Commission has sought their presence after 15 days of the order.
