Charges framed against 7 in terror funding case

JAMMU, Mar 5: Special Judge NIA Sunit Gupta has framed charges against Kifayat Rashid Koka, Azad Ahmed Koka, Ishfaq Majeed Koka, Altaf Ahmed Dar, Abid Hussain Bakshi, Mubarak Ahmed Thoker and Zubair Farooq Koka in terror funding case.
As per the NIA case, on January 21, 2020 an information was received that Kifayat Rashid Koka, son of Abdul Rashid Koka and Azad Ahmed Koka, son of Ghulam Mohi-ud-Din Koka of Shopian and their associates were collecting terror funds from unknown sources for delivering the same to the unknown terrorist organization ‘ANSAR- GAZWAT-UL-HIND’.
Accordingly, a case was registered under Sections 17/18/20/ 21/38/39 /40 of UA(P) Act and investigation of the case was assigned to DySP (HQ) CID-CI namely Sandeep Bhat. During the course of investigation, IO obtained the bank account details and mobile phone numbers of the suspected persons.
As per the bank account statements of the suspected persons on 19th and 21st September 2020 there was a credit entry of Rs 1.5 lakh and Rs 2 lakh in the saving bank accounts of these persons from J&K Bank Branch Nowabad Sunjwan and J&K Bank Bathindi Jammu respectively. Subsequently, the accused persons namely Kifayat Rashid Koka and Azad Ahmed Koka were taken into custody from Wachi Shopian.
It also came to the fore that accused Zubair Farooq Koka had collected the terror money amounting to Rs 16.00 lakh from a unknown person at Sunjwan. The said person was in contact with the terrorist Muzamil Manzoor Tantray and the terrorist Muzamil Manzoor was in contact with Ishfaq Majeed Koka and Altaf Ahmed Dar.
While complying the directions, the accused Zubair Farooq Koka had deposited Rs 3,50,000 in each of the bank accounts of Ishfaq Majeed Koka and Altaf Ahmed Dar and subsequently he had also deposited Rs 3.00 lakh in the bank account of Ishfaq Majeed Koka and Rs 4 lakh was deposited in the bank account of the accused Naseer-ul-Islam who happen to be the friend of cousin brother of Ishfaq Majeed Koka namely the accused Abdul Hanan.
Besides this, the accused Zubair Farooq Koka had deposited Rs 98,000 in the bank account of the accused Altaf Ahmed Dar and the accused Zubair Farooq Koka had also deposited Rs 1,02,000 in his own bank account. Subsequently he had transferred the said money from his mobile phone in the account of Azad Ahmed Koka and Altaf Ahmed Dar.
The accused persons Ishfaq Majeed Koka and Altaf Ahmed Dar had subsequently got the amount of Rs 2 lakh transferred from the account of accused Naseer-ul-Islam in the bank account of Abdul Hanan and they had also managed to transfer an amount of Rs 2 lakh from the account of Naseer-ul-Islam to the accused Wasim Ahmed War.
After hearing battery of lawyers for the accused persons whereas APP Anil Magotra for the UT, Special Judge NIA Sunit Gupta observed, “from the perusal of the oral evidence as well as digital evidence collected by the IO of the case during the investigation, it is prima facie proved that all the accused persons namely Kifayat Rashid Koka, Azad Ahmed Koka, Abid Hussain Bakshi, Ishfaq Majeed Koka and Altaf Ahmed Dar were working in sync to achieve their greater goal for flowing the terror money to reach its ultimate destination of terrorist Muzamil Manzoor Tantray”.
“The accused Mubarak Ahmed Thoker and Abid Hussain Bakshi were the part of conspiracy with Muzamil Manzoor Tantray, the AGuH terrorist to transport the two Pakistani terrorists with code names Sajid and Bilal from Surankote to Shopian for committing terrorist activities. But due to the swift action taken by the Surankote police and Army, the Pakistani terrorist could not reach to the destination and they were neutralized during the encounter”, the court said.
“The accused persons namely Kifayat Rashid Koka, Azad Ahmed Koka, Ishfaq Majeed Koka and Altaf Ahmed Dar are prima facie found to be guilty for the offences under Sections 17/39/40 of UA(P) Act whereas the accused persons namely Abid Hussain Bakshi and Mubarak Ahmed Thoker are prima facie found to be guilty for the offences under Section 17/18//39 of UA(P) Act”, the court said, adding “the accused Zubair Farooq Koka is prima facie found to be guilty for the offences under Sections 17/40 of UA(P) Act”.
