CB produces challan against 14 persons in drugs scam

JAMMU, June 20: In the much publicized spurious drug scam, Crime Branch today presented in the court of Special Judge Anticorruption Jammu the challan against 14 persons while as it has approached the Government for according sanction to prosecute the serving Government servants, whose involvement has also been surfaced in the scam.
The accused against whom chargesheet has been presented included, Ashok Kumar Raina and Amardeep Raina, sons of Baskar Nath Raina of Vinayak Nagar, Akhil Kumar Gadoo, son of I K Gadoo of Tomal Colony Bohri, Prem Prakash Barnwal, son of Ganesh Prasad of UP and his wife Manjula Barnwal, both Directors of M/s Sanative Pharmaceuticals, Manoj Kumar Agarwal, son of Krishen Murari Agarwal of Patna (chemist in M/s Sanative Pharmaceuticals), Rahul Kumar Singh, son of Triguna Singh of Chapra Bihar, Mukesh Agarwal, Prop of M/s Suraj Enterprises c/o Yogesh Dhawan of Satya Vihar Dehradun, Zubair Ahmad, son of Sain Mohammad of Jasola Vihar near Delhi, Neeraj Agarwal, son of Salekh Chandra Agarwal of New Delhi, Sunil Gupta, son of B K Gupta of Channi Himmat, Dr A K Sharma, the then Medical Superintendent SMGS Hospital, Dr Aniece Choudhary, the then Principal Government Medical College Jammu and Dr S C Khajuria, the then Assistant Director Family Welfare Department. The offences under Section 274, 420, 465, 467, 468, 471 and 12-B RPC read with Section 5(2) PC Act, 2006 have been established against all these accused.
The offences have also been established against Dr Madhu Khullar, the then Director Health Services and Chairperson of the Purchase Committee, Lotika Khajuria, Deputy Drug Controller, Reva Gupta, the then Administrator Associated Hospitals and Joginder Kumar, son of G L Sharma of Rajpura Magotrian. However, challan against them could not be produced for want of Government sanction for launching prosecution against them.
“All these persons are still in active service for which the matter is separately being taken up with the Government for accord of sanction and supplementary charge-sheet against them would be filed accordingly”, Crime Branch said, adding “departmental action is also being recommended against the members of Verification Board constituted by various units, on account of lapses on their part found during the course of investigation”.
The case regarding supply of spurious drugs was referred to Crime Branch by Commissioner Secretary Health and Medical Education Department for investigation and accordingly case FIR No.10/2013 under Sections 274, 420, 465, 467, 468, 471, 120B RPC read with Section 5(2) of PC Act was registered in Police Station Crime Branch Jammu on April 20, 2013.
Keeping the sensitivity of the case in view, the investigation of the case was directly supervised by Inspector General of Police, State Crime Branch. During the investigation, it has been established that  accused persons Ashok Kumar Raina, Amardeep Raina  and Akhil Kumar Gadoo dishonestly and fraudulently prepared fake and fictitious documents including partnership deeds/rent deeds of bogus firms.
After getting registered with GMC, Jammu, as a supplier firm,  the accused managed false, fake, fictitious and fraudulent documents in connivance with other accused persons associated with some pharmaceutical companies located outside the State, Thereafter in conspiracy with members of the Purchase Committee-II, the firm got the approval of rate contract for supply of Medley manufactured Maximizin-625 mg tablets to the Health Department.
“The accused had actually got the drug illegally and fraudulently prepared through M/s Sanative Pharmaceuticals, Selequi, Dehradun and supplied the same to the Health Department which was later found spurious”, the Crime Branch said in the charge-sheet.
After hearing CPO Kulbhushan Sharma appearing for the Crime Branch and Advocate Rohit Sharma for Dr A K Sharma and Dr Subash Chander Khajuria, the Special Judge Anticorruption Court granted them interim bail till next date of hearing subject to the furnishing of personal and surety bonds to the tune of Rs 20,000 each on the analogy that Chairperson of the Purchase Committee Dr Madhu Khullar has already been granted interim bail.
The Court remanded Akhil Gadoo, Ashok Kumar Raina and Amardeep Raina to judicial custody and sent them to District Jail Jammu till next date of hearing.
