CAT stays Kumar’s promotion as Director AH

JAMMU, Feb 20: The in-charge promotion of Davinder Kumar to the position of Director, Animal Husbandry has been stayed by the Central Administrative Tribunal, Jammu Bench.
The Division Bench consisting of Judicial Member Rajinder Dogra and Administrative Member Ram Mohan Johri has issued an order in this regard in a petition filed by Tariq Parvez. The Court noted that the impugned order dated 31.01.2025 was issued in contravention to the applicable regulations that applied to the matter.

According to the rules, a person with at least three years of experience as a Joint Director can be promoted to Director. However, in this particular case, the individual had only six months of experience. The Court also noted that the petitioner had been serving as a Joint Director for more than four years, and that Davinder Kumar, who had been promoted to Joint Director six months prior, had been promoted to Incharge Director disregarding the rules.
“Prima facie, the petitioner has made his case, and the impugned order dated 31.01.2025, is stayed till next date of hearing”, read the order. Further, CAT has issued notice to the State and private respondent to file their replies. After hearing the parties, the Court determined that the promotion order was, on its face, unlawful and incorrect.
