JAMMU, June 27: A Bench of Central Administrative Tribunal (CAT) comprising Judicial Member Sanjeev Gupta and Administrative Member Pragya Sahay Saksena has quashed the Advertisement Notification No. 04 of 2022 dated 27.07.2022 issued by the Service Selection Board in so far as the same relates to the post of Forester Jammu Division.
While quashing the Advertisement Notification, the CAT, after hearing Senior Advocate Abhinav Sharma with Advocate Ravi Abrol for the petitioner, also imposed cost of Rs 25000 on Chairman, Secretary and Controller of Examination of J&K Service Selection Board for violation of interim order dated 23.09.2022 passed by Tribunal to be paid to Advocates Welfare Fund, High Court of J&K, within a period of one month.
The petitioners filed petition seeking setting aside the impugned Advertisement Notification No. 04 of 2022 dated 27.07.2022 issued by the Service Selection Board in so far as the same relates to the post of Forester Jammu Division, figuring at Serial No. 193 and also seeking direction to the Service Selection Board to provide minimum qualification for direct recruitment to the post of Forester as Bachelor’s Degree in Science or equivalent qualification with at least one of the subject in Forestry, Botany, Zoology, Agriculture, Bio-Technology, Environmental Science, Horticulture, Science Subject” in pursuance of the judgment dated 04.12.2017 passed by the High Court in case titled “Mohd Yousuf Ganai & Others Versus State of Jammu and Kashmir and Others.
The CAT observed, “it is also not discernible as to how the minimum qualification for a junior post is higher than that of a senior post, that is, the minimum qualification for the post of Forest Guard (which is lower than that of Forester) is Bachelor’s Degree whereas that of the Forester is 10+2 with science subject”.
With these observations and in the facts and circumstances of the case, the CAT quashed the Advertisement Notification No. 04 of 2022 dated 27.07.2022 issued by the Service Selection Board in so far as the same relates to the post of Forester Jammu Division, figuring at Serial No. 193.
The CAT also directed respondents to amend the rules as undertaken by them and recorded by the High Court of J&K in its order dated 04.12.2017 in the case of Mohammad Yousuf Ganai and Others Vs State of J&K and Ors without any further loss of time.
