JAMMU, July 28: The Central Administrative Tribunal (CAT) Jammu Bench comprising Rajinder Singh Dogra and Ram Mohan Johri has issued a bailable warrant against Secretary, Health and Medical Education Department for not complying the order dated 23.08.2023 relating to medical reimbursement.
The case, originally filed in 2022, concerns the reimbursement of medical expenses amounting to Rs 25,82,361 incurred by an applicant suffering from Chronic Liver Disease (CLD) and Hepatocellular Carcinoma (HCC).
Since the required liver transplant facility was not available in Jammu, the applicant was referred outside J&K for treatment. The court had directed the respondents to reimburse the entire amount spent on the liver transplant and related treatment.
However, despite the judgment being passed more than three years ago, the respondents have failed to comply with the order. Over this prolonged period, the court has granted the respondents more than 12 opportunities to ensure compliance, but no effective steps were taken.
In view of the consistent non-compliance, the CAT has issued bailable warrant against the Health Secretary to secure his presence before the Tribunal. The warrant requires the contemnor to furnish a surety bond of Rs. 25,000. Further, the CAT has directed the Senior Superintendent of Police, Jammu, to execute the warrant and ensure the personal appearance of Secretary, Health and Medical Education, on the next hearing.
