JAMMU, Feb 16: Central Administrative Tribunal (CAT) Jammu Bench comprising Rajinder Singh Dogra (Member-J) and Ram Mohan Johri (Member-A) has directed the Excise and Taxation Department to insert applicant’s disability certificate in service records and promote him to post of Excise and Taxation Officer with all consequential benefits.
After hearing counsel for the parties and perusal of record, CAT observed, “the applicant Rajeev Gupta, a Sub-Inspector in the Excise and Taxation Department, approached the Tribunal seeking insertion of his disability certificate in his service record, reservation in promotion as a person with benchmark disability and grant of monetary benefits such as conveyance allowance with retrospective effect”.
“The applicant, suffering from post-polio residual paralysis with 44% permanent disability has alleged that the respondents have failed to grant him statutory benefits despite repeated representations since 1998”, the CAT observed, adding “on the other side the respondents content that the claim should be dismissed due to delay and laches as the applicant didn’t claim these benefits at the time of his initial appointment or promotion to Inspector in 2005″.
Keeping in view the facts of the case, the CAT directed the respondents to insert the applicant’s disability certificate in his service records and final seniority list of Inspectors. “The respondents are further directed to promote the applicant to the post of Excise and Taxation Officer (ETO)/State Tax Officer (STO) with all consequential benefits”, read the order of CAT.
Further, the CAT directed the respondents to consider the applicant for future promotions with retrospective effect from 2010 and provide due reservations.
