Cabinet nod likely to Victim Compensation Scheme, rules on study leave/deputation

JAMMU, Apr 18: The State Cabinet, which is meeting under the chairmanship of Chief Minister, Omar Abdullah on Saturday morning, would accord approval to the implementation of the Victim Compensation Scheme in the State and revisiting of rules relating to study leave and deputation of the Government employees in order to reinstate the provision of payment of salary and study allowance. The Cabinet will also order transfers and postings in the civil as well as police administration, which could not be affected in the previous meeting held on April 9 due to lack of consensus among the Ministers.
Official sources told EXCELSIOR that despite directions of the Supreme Court as well as Union Ministry of Home Affairs the State Government failed to formulate the Victim Compensation Scheme during the past several years.
“Now, as the compliance affidavit has to be filed in the Supreme Court, the Home Department has woken up from the deep slumber and is seeking approval of the Cabinet for the implementation of Victim Compensation Scheme in the State”, sources said.
The scheme is aimed at providing funds for the purpose of compensation to the victims or dependents who suffer loss or injury as a result of the crime and who require rehabilitation.
As per the proposed scheme, maximum limit of Rs 1 lakh compensation has been fixed for loss of life, Rs 2 lakh for death by torture in police custody, Rs 50,000 for loss of any limb or part of body resulting in 80% or above handicap, Rs 20,000 for loss of limb resulting in 40% and below 80% handicap, Rs one lakh for rape of minor or rape in police custody, Rs 50,000 for rape, Rs 20,000 for acid victims and Rs 10,000 for injury causing severe mental agony to women and child victims in the cases like that of human trafficking.
According to the sources, Cabinet will also discuss and take decision on the proposal of the Finance Department regarding revisiting of rules relating to study leave and deputation of the employees.
“In order to remove the difficulties faced by those who genuinely deserve to pursue higher studies, it would be appropriate to reinstate the provision of payment of salary and study allowance during study leave”, sources said quoting the proposal of the Finance Department.
If the proposal cleared by the Cabinet, a Government servant will draw leave salary equal to the pay the employee is drawing before proceeding on such leave in addition to the admissible study allowance. During study leave availed in India, a Government servant will draw leave salary equal to the pay and the payment of leave salary at full rate will be subject to the furnishing of a certificate by the Government servant to the effect that he is not in receipt of any scholarship, stipend or remuneration in respect of any part-time employment, sources said, adding no study allowance will be paid during leave for courses of study in India.
Moreover, all the departments will have to ensure that only genuine and deserving cases avail the benefit, sources said, adding the concerned administrative department will be competent to sanction the study leave and the General Administration Department on the recommendations of the administrative department concerned and with the consent of the Finance Department will grant study leave outside the State and within India.
Sources said that Cabinet will also consider the proposal regarding creation of posts of Superintendents of Police in Ministerial Executive (General) and Ministerial Executive (Steno) cadres in the State Police and creation of posts in the Employment Department.
